“Based on observation, documentation review, record review, and interview, a person established, conducted, and maintained a health care institution without a current and valid license issued by the Department. The deficient practice posed a risk as the unlicensed operation or maintenance of a health care institution is prohibited and is declared a nuisance inimical to the public health and safety, per A.R.S. § 36-430. Findings include: 1. The Compliance Officer observed ten residents on-site on April 4, 2025. 2. A review of Department documentation revealed the license had an expiration date of December 31, 2024, and was not reissued due to failure to pay renewal fees. 3. In an interview, E1 reported that the facility currently had 10 residents. 4. A review of documentation provided by the facility revealed that the facility provided medications and assistance with activities of daily living (ADL) to 10 out of 10 residents. The residents' medication administration records and ADL sheets showed documentation of receiving medication services and physical health services, such as but not limited to showers, grooming, and incontinence care, from January 1, 2025, to the current day from the facility. 5. In an interview, E1 acknowledged that the facility operated without a current and valid license issued by the Department.”
