Finding: Inconclusive Nature of Investigation: The Minnesota Department of Health investigated an allegation of maltreatment, in accordance with the Minnesota Reporting of Maltreatment of Vulnerable Adults Act, Minn. Stat. 626.557, and to evaluate compliance with applicable licensing standards for the provider type. Initial Investigation Allegation(s): The alleged perpetrator (AP) financially exploited four residents, Resident #1, #2, #3, and #4, when the AP stole narcotics, oxycodone and morphine tablets, from four residents’ medication supply. Investigative Findings and Conclusion: The Minnesota Department of Health determined financial exploitation was inconclusive. Documentation indicated the AP removed narcotics from Resident #1, #2, #3, and #4’s medication supply without documenting administration of the narcotics, however, there is not sufficient information to determine what happened to the narcotics. The investigator conducted interviews with facility staff members, including administrative staff, nursing staff, and unlicensed staff. The investigator contacted law enforcement. The investigation included review of residents’ records, facility internal investigation, facility incident reports, personnel files, staff schedules, law enforcement report, related facility policy and procedures. Also, the investigator observed a staff member administering narcotics to a resident and documenting the administration. Residents #1, #2, #3, and #4 resided in an assisted living memory care unit. Residents #1’s and #3’s diagnoses included dementia, Resident #2’s diagnoses included clouding of consciousness, and Resident #4’s diagnoses included short term memory loss. All four of the residents’ service plans included assistance with medication administration and had assessments indicating each desired the facility to manage their medications and had prescribed controlled substances the facility administered, tracked, and stored. Narcotic logbook (a log that indicating when staff members removed narcotics from supply) and medication administration record documentation review for Resident #1, 2, 3, and 4 indicated there were occasions when the AP documented removing oxycodone and morphine from supply and did not document administration of the medications. Review of the AP’s employee file indicated the AP received training regarding medication administration, medication administration records, and narcotic control books. During interview, a nurse stated she investigated reasons for a fall experienced by Resident #4 and noted the AP documented removing oxycodone more frequently than ordered and did not see the oxycodone documented in the resident’s medication administration record. The nurse stated she reviewed the narcotic logbook for further discrepancies and noted there was a pattern of residents having more narcotics removed when the AP worked at the facility. During interview, a second nurse stated she assisted in reviewing narcotic logs and medication administration records and found occurrences over a six-month period of the AP not documenting administration of oxycodone and morphine after removing oxycodone and morphine from supply for Resident #1, #2, #3, and #4. During separate interviews, a nurse and two unlicensed personnel stated the AP had a positive work reputation and they did not have previous concerns regarding the AP’s work performance. During interview, family members of Resident #1, #2, #3, and #4 stated they did not have concerns regarding care provided at the facility. During interview, the AP stated she always documented in resident narcotic logs after removing narcotic medications from residents’ supply and then documented the administration in the medication administration record. The AP denied occasions when she did not document medication administrations and denied stealing medications from residents. In conclusion, the Minnesota Department of Health determined financial exploitation was inconclusive. Inconclusive: Minnesota Statutes, section 626.5572, Subdivision 11. "Inconclusive" means there is less than a preponderance of evidence to show that maltreatment did or did not occur. Finding: Substantiated, individual responsibility Nature of Investigation: The Minnesota Department of Health investigated an allegation of maltreatment, in accordance with the Minnesota Reporting of Maltreatment of Vulnerable Adults Act, Minn. Stat. 626.557, and to evaluate compliance with applicable licensing standards for the provider type. Initial Investigation Allegation(s): The alleged perpetrator (AP) neglected the resident when the AP left chemical cleaner unsecured in the kitchen. The resident drank some of the cleaner and was transferred to the hospital via emergency services. Investigative Findings and Conclusion: The Minnesota Department of Health determined neglect was substantiated. The AP was responsible for the maltreatment. The AP left cleaning chemicals out in the kitchen in the memory care unit. The resident drank some of the chemical, experienced pain and burning in his mouth and throat, and was sent to the hospital. The investigator conducted interviews with facility staff members, including administrative staff, nursing staff, and unlicensed staff. The investigation included review of resident medical records, facility incident reports, personnel files, staff schedules, and related facility policy and procedures. Also, the investigator observed staff providing care and interacting with residents. The resident resided in an assisted living memory care unit. The resident’s diagnoses included dementia. The resident’s service plan included assistance with cognitive support and safety checks and the resident’s assessment indicated the resident was forgetful, confused, and had impaired decision-making. The assessment also indicated the resident slept on and off throughout the day and night. Resident progress notes indicated the resident saw a jug on the counter and thought it was water and poured some out and drank the contents. The AP returned from mopping the bathroom and saw the resident with a look of pain and disgust on his face. The resident indicated he drank contents from the jug containing chemicals because, “… it was dark and I wanted water, but the fridge was locked and that looked like a pitcher of water, so I poured it out in my mug and took a sip. After that I spit it out because it was bad.” The AP contacted staff and the manager on call regarding the incident. Emergency services was contacted, and the resident went to the emergency department. The resident returned from the facility later that morning and reported mouth pain when eating a few bites of food. The AP’s employee file indicated the facility educated the AP regarding use of chemicals for housekeeping tasks. Observation of facility revealed locked storage under the kitchen sink for chemicals and door code entry to the laundry room where other chemicals are stored. During interview, a leadership staff stated staff were directed to keep cleaning chemicals in a secured area when they were not using them. During interview, an unlicensed staff stated staff utilize chemicals for cleaning duties and are taught to keep chemicals secured. The unlicensed staff stated cleaning chemicals, including dish soap, are not to be left out because a resident could think chemicals are something to drink. During interview, the AP stated the facility provided education about keeping cleaning chemical secure. The AP stated she worked the night shift when most of the cleaning was conducted and obtained sanitizer from the laundry room to clean. The AP thought all of the residents were asleep and left the sanitizer on the kitchen counter and then proceeded to clean the bathroom floor. The AP heard commotion and went to the kitchen and saw the resident spitting in the sink. The AP questioned the resident and the resident stated he drank some of the cleaner that was on the kitchen counter because he thought it was water. The resident indicated he was experiencing burning and pain in his mouth and the AP contacted a staff member for support and called emergency services. In conclusion, the Minnesota Department of Health determined neglect was substantiated. Substantiated: Minnesota Statutes, section 626.5572, Subdivision 19. “Substantiated” means a preponderance of evidence shows that an act that meets the definition of maltreatment occurred. Neglect: Minnesota Statutes, section 626.5572, subdivision 17 “Neglect” means neglect by a caregiver or self-neglect. (a) "Caregiver neglect" means the failure or omission by a caregiver to supply a vulnerable adult with care or services, including but not limited to, food, clothing, shelter, health care, or supervision which is: (1) reasonable and necessary to obtain or maintain the vulnerable adult's physical or mental health or safety, considering the physical and mental capacity or dysfunction of the vulnerable adult; and (2) which is not the result of an accident or therapeutic conduct.
