Based on observation and interview, the manager failed to ensure food was prepared, served, and stored free from spoilage, filth, or other contamination and was safe for human consumption. The deficient practice posed a potential risk to the health of the residents. Findings include: 1. During an environmental inspection of the facility with E1, the Compliance Officers observed the following: - A tray of prepared dessert cups uncovered on a food cart in the refrigerator; - An opened bag of chicken nuggets tipped over on a shelf in the freezer; - A box of Organic Fudge Bars and chicken nuggets spilled on the freezer floor; and - An opened bag of bulk cereal in a cabinet just above the floor in a resident snack/dining area. 2. In an interview, E1 acknowledged E1 failed to ensure the aforementioned food items were kept free of spoilage, filth, or other contamination and were safe for human consumption.

Based on observation, documentation review, and interview, the manager failed to ensure that poisonous or toxic materials stored by the assisted living facility were in a locked area inaccessible to residents. The deficient practice posed a risk to the physical health and safety of a resident. Findings include: 1. The Compliance Officers observed several ambulatory residents on the premises. 2. During an environmental inspection of the facility with E1, the following poisonous or toxic materials were found in an unlocked cabinet under a common area sink accessible to residents: - Ecolab Advanced Antibacterial Clean & Smooth Liquid Hand Soap (two 1-gallon containers); - Ecolab Rapid Multi Surface Disinfectant Cleaner; - Odoban Disinfectant Multi-Purpose Cleaner; - Odoban Disinfectant Fabric & Air Freshener; and - Asepticare Aerosol Disinfectant Virucide. 3. The Compliance Officers observed the lock under the sink wasn't working properly. E1 immediately called maintenance to repair the lock. The Compliance Officers observed the maintenance staff working to resolve the issue. 4. The Compliance Officers observed a container of HDX Antibacterial Disinfecting Wipes in a cabinet above the stove in the aforementioned common area. The cabinet was not equipped with a lock and was accessible to residents. 5. The Compliance Officers observed a bottle of Odoban Disinfectant Fabric & Air Freshener in an unlocked cabinet in a common area bathroom, and a second bottle of Odoban Disinfectant Fabric & Air Freshener on top of a locked cabinet in another common area bathroom. Both bathrooms were accessible to residents. 6. A review of facility documentation revealed a policy titled "Environmental Services." The policy stated, "7. Toxic Chemicals...Toxic chemicals cannot be stored ...where residents with cognitive impairment have access." 7. In an interview, E1 acknowledged E1 had failed to ensure that poisonous or toxic materials were in locked areas and inaccessible to residents.
